These terms apply to all services provided by Pinnacle Design. By accepting a quote or placing an order with us, you are entering into a legally binding agreement and agree to these Terms & Conditions, along with any details outlined in your quotation.

1. services & payment

1.1 Design Brief & Quote:
– You will provide a design brief outlining the scope of work.
– Based on your brief, Pinnacle Design will provide a written quotation, valid for 30 days.

1.2 Concepts & Revisions:
– For most design projects, Pinnacle Design will provide initial concepts or draft layouts, the number of which will be specified in your quotation.
– For logo projects specifically, you will receive three (3) initial concepts.
– You may request up to three (3) revisions of your chosen concept (e.g. colour changes, layout adjustments, or other minor amendments within the scope of the original design brief).
– Major changes, new concepts, or revisions beyond this scope will be charged at our hourly rate (see Section 3).

1.3 Deposits & Payment:
– A deposit of 50% may be required before work commences.
– The balance is payable on completion, within the timeframe specified in the quotation.
– Work will not be released until full payment is received.

1.4 GST & Currencies:
– All prices are in Australian Dollars (AUD) and exclude GST unless otherwise stated.
– For international clients, you are responsible for any transfer fees or local taxes.

1.5 Copyright:
– Ownership of design copyright transfers to you only once full payment is received.

2. printing services

2.1 Payment for printing must be made in full, in advance, unless otherwise agreed.

2.2 Once you have approved a design for print, Pinnacle Design is not liable for errors or print quality issues.

2.3 Printing is carried out by third-party suppliers. We are not responsible for print quality, delays, delivery issues, or disputes with printers. Complaints must be directed to the supplier.

2.4 Printing cancellations must be made within 48 hours of quotation acceptance and before payment is processed. Cancellations after this time may not be accepted and full payment may still apply.

3. revisions & cancellations

3.1 Once a quotation is accepted and concepts delivered, cancellation is not permitted and payment is required in full.

3.2 Revisions included in your quote are final. Any additional changes will be charged at our current hourly rate.

3.3 Where work does not reasonably align with the design brief under Australian Consumer Law, Pinnacle Design may offer to re-perform services or provide a credit note. Refunds are not offered unless required by law.

4. client responsibilities

– Provide accurate and complete information for your design brief.
– Cooperate with project timelines, feedback, and approval processes.
– Make all payments as outlined in your quotation.

5. liability

– Our liability is limited to the amount paid for the specific service.
– We are not liable for indirect, consequential, or third-party losses.
– You indemnify Pinnacle Design against losses arising from incorrect information or instructions you provide.

6. confidentiality & privacy

Both parties agree to keep all non-public and sensitive information confidential. Personal information will be handled in accordance with Australian privacy laws.

7. agreement

– This agreement cannot be transferred or assigned without written consent.
– Both parties will comply with all relevant Australian laws.
– If any clause is found invalid, the remainder of the agreement will still apply.
– This agreement is governed by the laws of New South Wales, Australia.

8. late payments & debt recovery

8.1 Payment Terms:
– All invoices must be paid by the due date stated on the quotation or tax invoice.

8.2 Overdue Accounts:
– If payment is not received by the due date, Pinnacle Design may:
  – Suspend or withhold delivery of work; and
  – Charge interest on overdue amounts at 5% per month (calculated daily) until paid in full.

8.3 Debt Recovery:
– If an invoice remains unpaid 30 days after the due date, Pinnacle Design may engage a debt collection agency or commence legal proceedings.
– The client is responsible for all costs associated with recovery, including agency fees, legal fees, court costs, and administrative expenses.

8.4 Final Notice:
– Before commencing recovery action, Pinnacle Design will issue a written final notice allowing a further 7 days to pay.
